Layby Terms & Conditions (Important Notice)
These are summary terms only. The full Terms & Conditions and Layby Agreement will be provided to you before or immediately after purchase and will form the binding agreement between you and BudgetBuy Ltd.
By placing an order with BudgetBuy, you agree to be bound by our full Terms & Conditions.
Definitions
Catalogue – Products listed on our website.
Products – Items you order from our Catalogue.
Purchase Price – Total cost of the product(s), including GST and any applicable fees, as outlined in your Layby Agreement.
Delivery Fees – Charges for freight and handling.
We / Us / Our – BudgetBuy Ltd.
Your Information
You agree to:
- Provide accurate and up-to-date personal information.
- Notify us promptly of any changes to your contact or payment details.
- Authorise us to disclose information to debt collection agency or other third parties where necessary to recover overdue payments, in accordance with the Privacy Act 2020.
Sales Agreement
These Sales Terms apply to all purchases made through BudgetBuy. Additional product-specific terms may also apply.
If you do not agree with these terms, please do not proceed with your purchase.
Payment Terms
- Payments must be made in New Zealand Dollars.
- We prefer Direct Debit unless paying in full upfront.
- You are responsible for ensuring sufficient funds are available for scheduled payments.
- We are not responsible for any bank dishonour fees.
- Missed payments may result in cancellation of your agreement and applicable fees as outlined in the full Terms & Conditions.
Ownership of Goods
Ownership of the goods remains with BudgetBuy Ltd until the full Purchase Price and all applicable fees have been paid in cleared funds.
Delivery
- We aim to deliver goods within 14 working days after required payments have been received.
- Delivery timeframes are estimates only.
- Delivery fees range between $3 and $300 depending on product size and weight.
- Someone must be present to receive delivery.
- Photo ID may be required before the product is handed over.
- Once delivery has been confirmed to the address provided, responsibility transfers to you, subject to your rights under New Zealand consumer law.
- If delivery fails due to incorrect details or unavailability, storage fees may apply.
Cancellations
- You may cancel within 5 working days of receiving your agreement without penalty.
- A cancellation fee of $180 applies if:
- You cancel after 5 working days; or
- We cancel due to a material breach (including non-payment or repeated missed payments).
- This fee represents a genuine pre-estimate of our loss, including but not limited to:
- Administrative processing costs
- Staff time spent setting up and managing your account
- Payment processing fees
- Depreciation or loss in product value
- The cancellation fee will be deducted from payments made. If payments do not cover the full fee, you will be required to pay the outstanding balance.
We may cancel the agreement if:
- You breach a material term of the agreement (including non-payment or repeated missed payments);
- Goods become unavailable due to circumstances beyond our control; or
- BudgetBuy Ltd ceases trading.
Product Guarantee
- We will meet our obligations under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
- Nothing in our Terms limits your rights under New Zealand consumer law.
- Limitation of Liability
- We are only responsible for foreseeable loss resulting from a breach of our agreement. We are not liable for loss of profit where products are used for commercial purposes.
Age Confirmation
You confirm that you are 18 years of age or older and legally capable of entering into a binding agreement.
