Sales terms and conditions:

  1. Definitions
    1. Catalogue: 
Products listed on our website.
    2. Delivery fees: Separate charge for freight and handling.
    3. Products: Items you order from our Catalogue.
    4. Purchase Price: Total cost, including GST, as per layby agreement.
    5. Sales Terms: These terms and Layby Agreement cover pages.

  2. Your information :
    1.  Keep your info accurate; notify changes via email.
    2. We’re not liable if info changes without our knowledge.
    3. We may keep your info for up to 5 years.
    4. You have Privacy Act rights to access and correct your personal information.
    5. Agree to disclose info for credit checks, debt collection, and other purposes.
    6. Agree to a credit search, and your credit report must be satisfactory.
  3. Sales and purchase agrrement :
    1. These Sales Terms and conditions are the contract for buying and selling through our platforms. Additional product-specific terms also apply.
    2. Agree to buy and sell based on these terms. If you disagree, refrain from purchasing. Proceeding means you’re aware of and agree to these Sales Terms and conditions.
  4. Delivery terms :
    1. We aim to deliver within 14 working days after required payments. Delay due to payment issues. Delivery time is an estimate; no liability for delays beyond our control.
    2. Postage and handling charges range from $3-$300, based on product size and weight. Charges specified on sales terms form.
    3. If delivery fails, we’ll hold products until we confirm your address. Storage fee may apply for extended periods.
    4. Ensure someone is present during the delivery period.
    5. Not liable for missing or damaged products after delivery to the recorded address.
    6. Budget Buy will require you to have your photo ID before handing over the product.
  5. Payment terms in general
    1. We prefer Direct Debit for payment unless you’re paying the full purchase price upfront. Recurring debit setup on credit or debit card is also an option.
    2. Payments for products must be in New Zealand dollars, without deductions, set-offs, or counter-claims.
  6. DISCLOSURE OF FEES
    1. Kindly make sure your bank account has enough funds for payments. We’re not responsible for any bank fees, including dishonour fees.
    2. We may charge a cancellation fee, optional service charges, government fees, or fees for payments to third parties. For instance, delivery or storage fees, and a $1 per transaction direct debit fee.
  7. Cancellations
    1. We are entitled to cancel this agreement if:
      1. You have breached a material term of this agreement (including without limitation an unsatisfactory credit check as referred to in clause 2.6); or
      2. Owing to circumstances beyond our control, the goods to which the agreement relates are no longer available and no satisfactory substitutes can be reasonably obtained; or
      3. We have ceased trading (other than by way of receivership, liquidation or voluntary administration)
    2. We may charge a cancellation fee if you cancel this agreement after 5 working days or if we cancel it due to a material breach (e.g., non-payment). The fee covers any loss in value of the goods and reasonable administration costs. This will be deducted from any payments made, with any balance refunded. If the payments made do not cover the fee, you will need to pay the difference. No fees apply if cancellation occurs within 5 working days of receiving this agreement.
  8. Product Guarantee
    1. We’ll fulfill our responsibilities under consumer protection laws.
    2. No other warranties or representations, whether expressed or implied, are provided beyond what the law requires.
  9. General
    1. We’re only responsible for foreseeable losses from a breach of this agreement. No liability for profit loss if Products are used for commercial purposes.
    2. You confirm being 18 or older and having the sound understanding to agree to these Sales Terms as a binding contract.
  10. Complaints Process
    1. At BudgetBuy, fairness matters. If you have a complaint or don’t understand something, please email us at info@budgetbuy.co.nz. We’ll aim to resolve it within 5 working days. We’re committed to addressing and solving customer concerns fairly.
